Terms Conditions

1. Rom-Control Pty Ltd Used Equipment Warranty Policy:

1.1 Rom-Control Pty Ltd used equipment is sold as is, no warranty offered. When the “refurbishment” option is selected, the equipment is guaranteed to be in working condition and is warranted for one full year. All warranties are issued by Rom-Control Pty Ltd, and not the manufacturer and will be honored by Rom-Control Pty Ltd.

1.2 If the unit is found defective within one year of the invoice date, return it for a free replacement or repair. (If you need to make a warranty return claim please contact us at sales@Rom-Control.com.au or call 03 95434544). All Used products sold by Rom-Control Pty Ltd, are warranted to our customer only and as follows: such products shall be free from material defect (under normal use, storage, handling, installation and other normal conditions) for a period of 12 months from the date of sale.

1.2.1 Our obligation shall be limited to the repair or replacement, at our choice, of any such defective product (or part thereof as we determine) free of charge to our customer; if we decide that the product cannot be repaired or replaced, we shall credit your account in an amount equal to the sum you paid us for it.

1.3 Any warranty claim must be received before the end of the 12 month warranty period, together with return of the claimed defective product within this same period. 

1.4 This warranty is given in lieu of any other warranties, either express or implied, including that we disclaim any warranty of merchantability, fitness for a particular purpose and/or non-infringement. In no event shall we be liable for any damages except actual damages up to, but not exceeding, the amount paid to us for the product, including we shall not be liable for any consequential or indirect damages or lost profits whether or not advised of same. 

1.5 Rom-Control Pty Ltd, is not a distributor authorised by the original manufacturer and we are not a party to any manufacturer’s warranty that may or may not apply. 

2. Rom-Control Pty Ltd Used Equipment Non-Warranty Return Policy: 

2.1 If you are dissatisfied with a product from Rom-Control Pty Ltd you may return the product within 30 calendar days of the invoice date. A 20% restock administration fee will apply to all non-warranty returns.

2.2 No non-warranty returns will be accepted 30 days after the invoice date. (If you need to make a non-warranty return claim please contact us at sales@Rom-Control.com.au or call 0395434544).

3. Repaired/Refurbished Products:

3.1 All products repaired by Rom-Control Pty Ltd, are warranted to our customer who presents same for repair as follows: all repaired components thereof shall be free from defect in materials and workmanship (under normal use, storage, handling, installation and other normal conditions) for a period of 12 months from the date of our repair invoice. Our obligation shall be limited to the repair or replacement, at our choice, of any such defective component free of charge to our customer; if we decide that the component cannot be repaired or replaced, we shall credit your account with us in an amount equal to the sum you paid to us for the repair. 

3.2 Freight remains the responsibility of the customer. Any warranty claim must be by written notice to us received before the end of the 12 month warranty period, together with return of the claimed defective product within this same period. 

3.3 This warranty is given in lieu of any other warranties, either express or implied, including that we disclaim any warranty of merchantability fitness for a particular purpose, quality, and/or non-infringement.

3.4 In no event shall we be liable for any damages except actual damages up to, but not exceeding, the amount paid to us for the product, including we shall not be liable for any consequential or indirect damages or lost profits whether or not advised of same.

4. New Products:

4.1 All new products sold by Rom-Control Pty Ltd, are subject to the terms of any and all original manufacturer’s warranty/ies that may apply. Rom-Control Pty Ltd, provides no warranties regarding such new products, including we disclaim any warranty of merchantability, fitness for a particular purpose, quality, and/or non-infringement. In no event shall we be liable for any damages except actual damages up to, but not exceeding, the amount paid to us for the product, including we shall not be liable for any consequential or indirect damages or lost profits whether or not advised of same. 

5. Other Terms:

5.1 All sales and services are presumed to have taken place in Victoria and those above-described warranties provided by Rom-Control Pty Ltd, shall be construed under Victorian law, without regard to conflict of law provisions. Venue for any dispute arising hereunder shall be in that State or Federal Court nearest to the main office of Rom-Control Pty Ltd. The parties hereby agree to personal jurisdiction over them in such Courts. Rom-Control Pty Ltd, shall be entitled to attorneys’ fees and costs including pre and post judgment should it have to enforce its right under this transaction.

5.2 Customer warrants that it is and shall remain in full compliance with any applicable Australian, State and/or local regulations controlling the sale and delivery of goods and is and shall remain solely responsible therefore. The terms set forth herein constitute the entire agreement regarding this transaction, except for product and/or service description and pricing, and subject only to our credit agreement (if any) with you, our invoice and our separate order confirmation.

5.3 In the event any part of these terms is deemed unenforceable by a court having jurisdiction thereover, such unenforceable term(s) shall be modified to make them as enforceable as possible, and the rest of these terms shall not be affected. Any contrary terms offered by the Customer are not a part of this transaction. Customer shall defend, indemnify and hold Rom-Control Pty Ltd, and its agents harmless from any breach by it of these terms or any misuse or abuse by it of any item sold and/or serviced hereby. 

5.4 The goods sold hereunder shall be at the risk of the Customer upon delivery by Rom-Control Pty Ltd to the carrier F.O.B. shipping point. Title to the goods sold hereunder shall remain in Seller until payment in full by Buyer. 

5.5 Rom-Control Pty Ltd shall not be responsible for delays caused by manufacturing plants, transportation, strikes, fires, floods, storms, war, insurrections, riot, any governmental regulation, order, act or instruction, or any other circumstances beyond its control, and Customer hereby waivers any claims relating to same. 

General Terms and Conditions 

1. Packaging/Handling Fee:

1.1 Surging fuel costs require we charge a $12.50 Handling Fee for all Rom-Control Pty Ltd purchases. This charge offsets costs relating to shipping and packaging supplies for products delivered to our facility.

2. Payment for goods and serrvices: 

2.1 Customer represents that any supplied credit card or similar information is true and correct and customer has all proper rights in same, that all charges will be honored by customer’s credit card company and that it will pay all credit card fees as charged. 

3. International Orders 

3.1 Orders that are shipped to countries outside of Australia may be subject to import taxes, customs duties and fees levied by the destination country. 

3.2 These charges for customs clearance must be paid by the recipient; we have no control over these charges and cannot predict what they may be. 

3.3 Customs policies vary widely from country to country. Please contact your local customs office for information. When customs clearance payment and/or procedures are required it can cause delays beyond our delivery estimates. 

3.4 Credit Card verification may take up to 72 hours. EFT Payments: Allow 3 – 5 business days for receipt of funds.

4. Minimum Order Charge 

4.1 In order to maintain a high quality process there is a $275.00 minimum order required. 

5. Changes to the condition of works:

5.1 In the event that the customer decides to withdraw their intention of proceeding with the service otherwise agreed to by providing a valid payment or Purchase Order, the customer will be liable for:

–           paying for our minimum charge

–           paying for the cost accrued by Rom-Control until the point when the change occurred

–           paying for freight and handling cost associated with the return of the equipment
